These Terms of Service (“Terms”) govern your use of the FlatmatesCo mobile application (“App”) and services (“Services”) provided by FlatmatesCo (“we”, “our”, “us”).

By accessing or using the App, you agree to these Terms. If you do not agree, you must stop using the App immediately.

 

1. Eligibility

  • You must be at least 18 years old to use the App.

  • You must register with a valid phone number and verify your work email address.

  • The App is currently available only in India.

 

2. Account Registration & Security

  • You are responsible for maintaining the confidentiality of your account credentials.

  • You are responsible for all activity that occurs under your account.

  • You agree to provide accurate, current, and complete information during registration and keep it updated.

  • We reserve the right to suspend or terminate accounts that provide false or misleading information.

 

3. Services Provided

  • The App allows users to post room listings and search for potential flatmates.

  • Access to certain features may require a paid subscription or one-time payment.

  • We do not guarantee that you will find a flatmate or room through the App.

4. Subscriptions (Auto-Renewable)

Some parts of the Service are available on a subscription basis (“Subscription(s)”). Details are as follows:

  • Subscription Name, Duration, and Price: As displayed in the App Store at the time of purchase.

  • Auto-Renewal: Subscriptions automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current billing period.

  • Billing: Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current subscription period at the cost shown in the App Store.

  • Management: You can manage and cancel your subscriptions at any time by going to your Apple ID account settings after purchase.

  • Free Trial (if offered): Any unused portion of a free trial will be forfeited when you purchase a subscription.

  • Refunds: All subscription payments are non-refundable, except where required by applicable law.

5. Payments & Refunds

  • Payments for subscriptions or other paid features are processed via third-party payment providers.

  • All prices are in Indian Rupees (INR) unless otherwise stated.

  • No refunds will be issued unless required by applicable law or explicitly stated otherwise.

  • We do not store your complete payment card information.

 

6. User Responsibilities

You agree to:

  1. Use the App only for lawful purposes.

  2. Respect the rights and privacy of other users.

  3. Post accurate and truthful information in listings.

  4. Avoid spamming, harassing, or abusing other users.

 

7. Prohibited Activities

You may not:

  • Post false, misleading, or fraudulent listings.

  • Share another person’s personal information without consent.

  • Upload content that is offensive, illegal, or infringes on third-party rights.

  • Use the App for commercial advertising unrelated to room sharing or flatmate search.

  • Attempt to hack, disrupt, or reverse-engineer the App.

 

8. User-Generated Content

  • All content you post (text, images, listings) is your responsibility.

  • We do not endorse or guarantee the accuracy of user-generated content.

  • We may remove any content that violates these Terms or applicable laws.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

 

10. Third-Party Services

The App integrates third-party services (e.g., Supabase, MapBox, Google Maps API, payment processors). We are not responsible for any issues, losses, or disputes arising from their use.

11. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any damages, losses, or disputes arising from your use of the App, including interactions with other users.

  • We do not guarantee the accuracy, completeness, or availability of listings.

  • You use the App at your own risk.

 

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses arising from:

  • Your use of the App.

  • Your violation of these Terms.

  • Your infringement of any rights of another person or entity.

 

13. Service Availability

  • We may update, modify, or discontinue the App at any time without prior notice.

  • We are not responsible for service interruptions due to maintenance, upgrades, or technical issues.

 

14. Termination

We may suspend or terminate your account if:

  • You violate these Terms.

  • You provide false or misleading information.

  • You engage in activities harmful to the App or its users.

Upon termination, your access to the App will cease immediately, and we may delete your account data as outlined in our Privacy Policy.

 

15. Dispute Resolution & Governing Law

  • These Terms are governed by the laws of India.

  • Any disputes shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra.

  • We encourage resolving disputes through direct communication before seeking legal action.

 

16. Changes to These Terms

We may update these Terms from time to time. Any changes will be effective immediately upon posting in the App. Continued use of the App after changes means you accept the updated Terms.
